Because the court ruling setting this new precedent was just made on August 7, 2025. The decision basically says that it does not matter what the Land Title Act and any search done under that Act says. If Aboriginal title is established, it trumps fee simple titles (regardless of any land title search result). That's one of the reasons why this decision is so serious and many lawyers are sounding the alarm: you can no longer rely on the Land Title Act to determine whether you have property rights.
