When you serve a plenary summons, you disclose your personal data only for the purposes allowed by Order 1 Rule 2 of the Rules of the Superior Courts. You consent to disclosure for two purposes only: first, to allow the defendant to enter an appearance in person or through an identified solicitor who is a natural person holding a practising certificate; and second, to allow service of documents on you at the address or email you provide, and only by an identified natural person, either the defendant or a named solicitor. You do not consent to disclosure to an LLP. An LLP is not a natural person, cannot hold a practising certificate, cannot sign documents, and cannot give or receive consent. Under Order 12 Rule 9, the defendant’s memorandum of appearance is the first service of documents. It must identify the defendant in person or an individual solicitor who consents to service. When that appearance is served on you, you then have valid consent from a named natural person for service of the statement of claim. You may serve the statement of claim only on that identified person. If the appearance is signed by an LLP, the appearance is invalid. No natural person has entered an appearance. No valid consent exists. Your personal data has been disclosed to an unauthorised recipient. Under sections 144 and 145 of the Data Protection Act 2018, unauthorised disclosure of personal data is a criminal offence. The maximum penalty is a fine of fifty thousand euro or five years imprisonment. The Rules of the Superior Courts establish the lawful pathway for disclosure and service. They require identification of the natural person responsible at each procedural step.
