This ruling is a huge miss from the high court. Graffiti is art and there’s no reasonable explanation for its ban on matatus. This very art is part of Kenyan Culture.
Recusal of a judge of the Supreme Court sitting to hear a presidential petition is not tenable. The rule and the previous custom and practice has been that the bench of SEVEN must sit as a whole. So Judge Katwat Kigen’s recommendation that he can recuse himself during a presidential petition is not founded in law. Recusing himself during the presidential petition would seriously affect the quorum of the court, thus rendering it inoperative.
