This is probably the closest thing we have to an “action” photo during the Civil War. It was taken from an upper story window in Frederick Maryland. The location is on East Patrick Street, looking towards its intersection with Market Street. The photo was probably taken in July 1864 (but might have been taken September 1862).
The column of Confederate soldiers has halted in the street. The photographer takes advantage of their momentary pause to take a reasonably clear picture - only 2 or 3 of the soldiers, out of a group of perhaps 100, realize that they are being photographed:
