The child was taken without a warrant required by OK Const A2S30 (“emergency orders” are statutory and not judicial) and custody was taken without due process of law. Legislators know this but they continue to cite statute as though the boy’s well-being isn’t a liberty interest of his parents. A grand jury would be better to investigate

@ConnieEB @RightScopee Wrong: K-12 students do not have the right to freely leave campus during school hours. Statelaws require schools to track attendance and maintain duty-of-care, leaving without following proper checkout procedures (such as being signed out by a parent) is considered truancy.

@Pmdiet13 @RightScopee My issue isn't about the principal telling the kids to go back to class or threatening to suspend. He misspoke about their rights. The subject of the protest isn't what I am commenting on.

@ConnieEB @RightScopee So the students would miss class and sit in the office until their parents interrupted their workday to come to the school to check out their underaged children to attend a protest unsupervised? That would never happen.

@ConnieEB @RightScopee They are minors and under the supervision of school authorities. Students do NOT have the right to supersede the school’s authority and walk out of class and off campus. They can protest after school with their parent’s permission.

@ConnieEB @RightScopee There’s all sorts of possible angles to look at it. The issue is that the law is precise and will isolate parties according to status/duties/etc. A minor leaving the care of a trustee is not a light issue. A trustee warning of consequences may not be wrong.

This is where we’d need to know what the trustee’s duties and responsibilities are. Schools are made available for the public good and have a purpose. I don’t know if each parent checked these students out. What happens when a trustee made responsible for a child lets the child leave their care contrary to the purpose of the trust reposed in them by the parent?

@ConnieEB @RightScopee NOT true— in the first year of law school, they teach their class about “Citizens Rights”, include strongly, making the point ALL RIGHTS HAVE LIMITS! The classic example frequently given is, “you can’t yell fire in a crowded theater.!”
