No one put a gun to Fernando Tatis Jr.'s head. He voluntarily chose to take $2 million and understood the risk of having to pay back a lot more. It wasn't a loan. If he didn't make it to MLB, then he owed nothing. Easy to blame people in his circle, but it was his choice.

#FernandoTatisJr

ICYMI, sports law Professor Mike McCann has proposed a bold, innovative alternative to fix college sports without Congress intervening. It’s called “STOP BREAKING THE RULES YOU AGREED TO FOLLOW.” Brilliant. 👏🏼 Why didn’t anyone think of that sooner? @McCannSportsLaw

As the SCORE Act is punted, I propose a different solution for college athletics: How about colleges follow NCAA rules? No fake NIL. No incentivizing lawsuits to extend eligibility for many years. No bill in Congress can cure the underlying problem. sportico.com/law/analysis/2….

@marcisenberg @drridpath D1 SAAC members represent the entire landscape. You’d rather cherry pick two P4 rev sport athletes? You gotta be smarter than this, right?

Funny what happens when we don’t rely on the NCAA’s D1 SAAC members, which represents all athletes, and instead hear from college athletes who might benefit from employment status and bargaining power 🤔
Ben Portnoy@bportnoy15

Interesting nugget that came out of Rep. Trahan's presser was a question on whether athletes want to be employees. The NCAA, conferences, etc. have said they don't. WBB players Brooke Daniels (Michigan) and Oluchi Okananwa (Maryland) pushed back on that assessment:

The SCORE Act would let colleges and the NCAA cash in on billion-dollar sports while denying the athletes generating that money the basic rights every worker deserves. If you can make billions off their labor, you don’t get to pretend they’re not workers.

The Big Ten has distributed $1.37 billion to its member schools for the fiscal year ending June 30, 2025. (And, yes, they're still claiming there's a "crisis" that requires the federal government to intervene.) nbcsports.com/nfl/profootbal…

A common misconception about Title IX in college athletics is assuming that cutting both a men’s and women’s program in the same sport is a safe harbor from Title IX liability. Athletics Directors who make that assumption do so at their peril. That’s rarely the case. #tennis

Don’t be surprised if lawsuits are filed relating to the decision to not grandfather athletes into the NCAA’s age based eligibility rule. It’s similar to the situation after NCAA rules allowed Alston awards (Hubbard case) & NIL pay (House case). Tough spot for the NCAA.
