In para 268(b) of Presidential Petition E005 of 2022, the Supreme Court determined that rejected votes are not included in “votes cast” set out in Article 138(4). In my layman’s understanding, this amounted to disenfranchising those voters who had taken the time to register, to show up at the polling station, to queue and mark their ballot, and to cast that ballot in a ballot box - but for some error, could not be credited to any candidate. That effort, that “sovereign power” should count for something - at least be part of the total in determining 50%+1. Article 1 on sovereign power belonging to the people should trump all other considerations. Article 86(b) clearly defines “votes cast” as: “the votes cast are those that are counted, tabulated and the results announced promptly by the Presiding Officer at each Polling Station.” That ought to be source of the denominator in 138(4)(a), and that number comes from Form 34As, aggregated to Constituency, County and National levels. In a polling station, the rejected votes are an integral part of the reconciliation of the counting and tabulation to determine the integrity of the number of votes cast. Verification is incomplete without considering rejected votes.

I had the wonderful opportunity to moderate a high-level fireside chat with His Excellency Dr. @WilliamsRuto , President of the Republic of Kenya and Global Champion for Affordable Housing for All, at the @2ndauf in Nairobi, Kenya. It was a truly engaging and insightful conversation. His Excellency took the time to explain how he has prioritized affordable housing within Kenya’s national agenda, and how he has mobilized resources to turn this political commitment into a reality for millions of Kenyans. It was also a candid exchange, in which he openly shared both the progress made and the challenges he has faced, and continues to face, in delivering such a bold and transformative agenda. I remain deeply grateful to the entire team at the @HousingUrbanKE and @UNHABITAT for this wonderful opportunity. Many thanks to Hon. @PSCharlesHinga , Hon. Yesterday, we were truly honoured to welcome His Excellency Mr. @arnaud_suquet , the French Ambassador to Kenya (@FranceinKenya), to @StareheGirls - exactly one month after he promised to visit. Truly walking the talk. His interaction with our students was inspiring. From engaging with our French learners to answering thoughtful questions from the girls, his passion for youth empowerment and education was evident. We are grateful he was joined by teams from @CampusFrance and @sciencespo (my alma mater), who shared exciting higher education opportunities in France. A beautiful moment to showcase our school and continue strengthening this valued partnership with @FranceinKenya . I seriously need some help here. My neighbor just put up this massive metal fence right along our property line and I’m honestly pretty upset about it. It completely changed the whole feel of my driveway and now it looks like I’m pulling into some kind of industrial corridor. I had no idea this was even happening until the thing was already built. It feels like my space just got boxed in overnight. What on earth can I do in a situation like this???
