Pour les cours et les tribunaux, la bonne décision n'est pas la plus facile où la plus difficile. N'est pas aussi la plus populaire. La bonne décision doit être sereinement impartial et basée sur la loi. Le reste est seulement l'écume des jours.

Comme le rappelle @JulieCouturier_, l’État de droit repose sur des principes essentiels : l’égalité devant la loi, la séparation des pouvoirs et la hiérarchie des normes. Ces principes appellent les responsables politiques à la prudence lorsqu'ils critiquent la justice. Cette critique doit être mesurée, car la justice ne peut pleinement remplir son rôle que dans un climat serein, à l’abri des pressions et des attaques. Je tiens à rappeler que l’indépendance de la justice est une garantie pour tous les citoyens, quelle que soit leur opinion ou leur appartenance politique. Les cours et tribunaux n’ont pas pour fonction de représenter la voix du peuple, mais d’assurer que le droit soit appliqué de manière impartiale, dans le respect des lois et des principes fondamentaux de l’État de droit. Remettre en cause cette indépendance, c’est fragiliser la démocratie et affaiblir les droits de chacun.

#CostaRica: Me preocupa las recientes reformas legislativas que reducen el financiamiento judicial, debilitando la capacidad del poder judicial para administrar justicia de manera efectiva e independiente, en un entorno de creciente violencia e influencia del crimen organizado. Los informes indican que estas reformas ocurren en un contexto en el que el Poder Ejecutivo ha intensificado las tensiones con el poder judicial a través de declaraciones públicas y ataques verbales, particularmente cuando no está de acuerdo con fallos o decisiones judiciales. Se informa que estas declaraciones, a menudo realizadas durante conferencias de prensa semanales, están afectando negativamente la estabilidad del sistema de justicia. La interferencia política en el poder judicial, junto con recursos insuficientes para combatir el crimen organizado, ha generado graves riesgos para jueces y fiscales, incluyendo amenazas directas y ataques. Insto a las autoridades costarricenses a tomar medidas urgentes para garantizar la independencia judicial, proteger a los funcionarios de justicia y garantizar el derecho a un juicio justo de acuerdo con los estándares internacionales. spcommreports.ohchr.org/TMResultsBase/…
