At the time he was shot, he was on the ground being restrained by 5 other officers, and as video analysis shows, disarmed.
From what we see, the officer who removed the gun said "gun" and moment later they put at least 4 holes in him.
Let me say this so it's clear - nothing he did or is accused of doing, justifies a death sentence.
The legal punishment for assaulting a police officer is up to 2 years in prison because under the under the Assaults on Emergency Workers (Offences) Act of 2018, it is treated as an aggravated assault.
The legal punishment for resisting arrest, at a minimum is a month in lockup, to 6 months depending on the seriousness, or up to 2 years imprisonment if it qualifies as assault.
In this situation, the ONLY justification an officer would have for use of deadly force is if he/she had an objectively reasonable belief that the person poses an immediate threat of death or serious bodily harm to the officer or others.
I cannot look at what happened and say any of them had an objectively reasonable belief that he posed an IMMEDIATE threat of death or bodily harm.
Not with them having overwhelming numbers, all of them armed, with vests, with multiple people holding him down.
I've tried, and I just can't square it away.
And to make it worse, reports show that they tried to send the police away when they arrived to secure the scene, and failing that, they began detaining witnesses.
None of this is right by any stretch of the imagination. Not to me.
That's not the point here. I am not sure why you guys deflect so much. Alex Pretti had the right to carry. What he doesn't have the right to do is go to a coordinated protest against federal law enforcement and agitate and assault ICE agents while resisting arrest.
That's the problem.
