I don’t like @rigathi’s toxic and petty politics. I’ve disliked it since I found him at the University of Nairobi in 1986 singing “KANU and Moi Juu, Juu Kabisa!” But as a man who is fully committed to fairness, justice and the rule of law, I believe that the Court’s ruling today was predetermined, is legally unsound and factually faulty. It should be overturned on appeal. The impeachment of Gachagua was not conducted fairly, was unjustly rushed and was motivated by parochial personal differences with @WilliamsRuto. The court ought to have nullified it.

Constitutional Division of our High Court holds that the Constitutional Rights of Gachagua were violated but proceeds to compensate him for the violation instead of annulling the process. The High Court has given the Court of Appeal an easy bifurcated choice: affirm the violation & nullify the impeachment or set aside the alleged violation & confirm the impeachment. The decision of the High Court is a judicial absurdity: REDUCTIO AD ABSURDUM!

High Court says Gachagua not given fair hearing. This must vititiate the impeachment, as a matter of course; it follows, as a matter of course. Also, does this mean he is free to vie for public office? Surely, one cannot be barred from public office based on an unfair hearing!

Under Article 25(c) of the constitution, the right to fair trial is a non-derogable right. So how can the court make quasi constitutional excuses on amorphous grounds in its refusal to set aside the impeachment of Hon Rigathi Gachagua? The Gachagua judgment in my humble opinion is on a shaky, shallow, soggy and sandy soil.

You are shutting down a major road for 8 months? 🤔🤔🤔. 8 months? With no alternative? In Nairobi?

He ought to win based on the finding that he was denied a fundamental right when his adjournment request was rejected after all senators admitted that he was ill! The court erred by disregarding this significant finding!
