The #PeterboroughDomesticAbuseNetwork (#PDAN) is hosting a virtual workshop on April 24, 2025, at 10:00 a.m. about legal options available to obtain conditions to protect people who are experiencing #sexual (#SV) and #intimatepartnerviolence (#IPV) other than #police intervention. These include obtaining a #PeaceBond, #PrivateProsecution and/or applying to the #FamilyCourt for a #Restrainingorder. A discussion will also be had about how to support survivors charged after having reported SA or IPV to the police and how survivors of IPV and SA can pursue civil claims for damages against the perpetrators as an alternative to the criminal justice system. Thank you, #AngelicoDino of #LawTimes, for bringing this #DivisionalCourt appeal of a decision made by the #HumanRightsTribunalofOntario (#HRTO) to our attention. This decision provides an excellent example of how HRTO has dismissed applications on procedural grounds without proper consideration. As noted by #TribunalWatchOntario lnkd.in/gmgbPKZT, 93% of HRTO's decisions that they reviewed "were dismissals of claims without a hearing," which is contrary to HRTOs original purpose, which was to be accessible for unrepresented people. In this case, the claim was dismissed by HRTO because they found that most of his allegations of discrimination had occurred more than one year before his application. The Divisional Court ruled that although HRTO had cited the correct legal test for determining whether there was a "series of events," they had failed to apply these factors properly and had refused to accept additional evidence offered by the complainant despite having asked for it in the notice they sent out to him for this summary hearing, thereby denying him procedural fairness.
