これは実務的な対応の話なんですが、 内部通報を受け取った→通報窓口で内容を精査→けれど事実として認定さなかった このケースの場合、通報そのものは公益通報としては基本的に認定されません。法の趣旨から見れば「事実でなかった場合も公益通報として成立する」というのが一般的な見解ですが、実態は違っていて、通報と認定されなかった通報者に対する解雇や左遷は「公益通報者保護法」で完全に守られてもいませんし、この場合においては「通報対象事実が認定されるか否か」が争点となります。 兵庫案件で言えば、通報事実が認められなかった場合に罰則を受ける可能性が高いのは県民局長であり、この場合、公益通報者が罰則を受ける事案に繋がり、一見すると上記の法解釈として矛盾しているようになりますよね。 これが公益通報者『保護法』です。不利益取り扱いを禁止するための法律であって「公益通報であるか否か」を問う法ではありません。 「事実認定されなかった通報は公益通報には該当しない」という解釈が前提になければ、他の法とのバランスもうまく取れませんし、保護法はあくまで「不利益取り扱いを防止する措置に過ぎない」というのが実態である以上、事実認定のできなかった通報を「公益通報とは呼ばない」がより正確な法解釈であると、私は考えます。

Russia just lost its only working launch pad for the space station. On November 27, 2025, a catastrophic accident occurred at Baikonur Cosmodrome’s Pad 31/6, Russia’s sole remaining site capable of sending crew and cargo to the International Space Station. Minutes after the successful liftoff of Soyuz MS-28 (carrying two Russian cosmonauts and one NASA astronaut), a 130-ton mobile service gantry known as 8U216 collapsed and flipped upside-down into the 20-meter-deep flame trench beneath the pad. Drone footage captured the massive Soviet-era structure (built in the 1960s) lying inverted and heavily damaged. Roscosmos quickly confirmed that several critical components of the launch pad were destroyed and declared the site out of service indefinitely. The 8U216 gantry is essential for final servicing of Soyuz rocket engines and installation of pyrotechnic initiators. Normally retracted into a protected recess before ignition, it appears to have been violently sucked out of position by the pressure wave and exhaust plume during launch, likely due to failed or unlatched locking mechanisms. The collapse effectively eliminates Russia’s independent ability to reach the ISS. No other Russian launch complex is currently human-rated or able to deliver spacecraft to the station’s 51.6° orbital inclination from Russian territory. Repair timelines remain uncertain: the platform may be beyond salvage, requiring a complete rebuild that could take anywhere from several months to multiple years. This puts upcoming missions in jeopardy, including the Progress MS-33 cargo flight and the Soyuz crew rotation currently scheduled for July 2026. Already strained by the full-scale invasion of Ukraine in 2022, which cost Roscosmos most of its commercial launches, international cooperation, and access to foreign sites such as Europe’s Kourou spaceport, this latest incident represents one of the most serious blows to Russia’s human spaceflight program in decades.
