Coaches sell the dream. Administrators enforce the contract. When that time comes, the legal department—not the coaching staff—will do it . Terms in revenue sharing contracts that should automatically raise a red flag: - Release clause that discharges the school from any and all liability arising out of the agreement. In other words, you have zero recourse if/when the school breaches the agreement. - A unilateral indemnification clause that requires the athlete to indemnify the school for all claims arising out of the agreement. Common trend we’ve noticed in this round of rev share negations: School sends a player a 25-page contract and tells him he has 24 hours to sign it, or else the deal is off. Inevitably, these contracts usually contain a clause that says something to the effect that “…student-athlete acknowledges his right and ability to have the opportunity to seek assistance of any lawyer…” Makes you wonder, why the rush?
