I would join the condemnation of the AAP defectors for betraying the values and ideals of AAP if anyone could tell me what the values & ideals of AAP are. I can’t seem to find any

@Gurpret_Sandhu6 @Gagan4344 What Sibbal sahib is saying is that the merger of the original party dint happen in this case, only numbers have crossed the required threshold for protection from disqualification. So it’s a deemed marger, which will be challenged at the SC. Chaddha has used a loophole in law.

Both are different. In this case, all the 7MPs are safe. Because they're meeting the two-thirds threshold.

Chairman is obviously a political post & the authors of tenth schedule very well understood it. Hence, judicial review is prudent. Violation will be decided by the court not by a political appointee!

@Gurpret_Sandhu6 @Gagan4344 PT Usha? She wasn’t sent to RS by state legislative assembly quota but through sports quota. This is a case of illegal merger, wherein original party, its leader & the legislative assembly wasn’t consulted. I am sure BJP has it sorted on Chairman, Prez level. SC will nullify it.

@ArchieSriva @Gagan4344 No need to consult the PB Assembly, rules are the same for every House, whether it is the LS, RS, or VS, VP.
They are indirectly elected, not nominated. Nominated members are those appointed by the Hon’ble President of India, eg: Satnam Singh Sandhu, P. T. Usha, etc.

@Gagan4344 This will not help; Recall is nowhere mentioned in the Constitution. They're fulfilling the two-thirds split requirement under the Anti-Defection Law, mentioned under the 10th Schedule.

I concur. The constitutionality & powers of Punjab legislatures must be respected. You can’t get elected by them & then go rouge against same party. That’s a clear violation of the elected assembly, which sent you to RS in the first place.

Supreme court must acknowledge the constitutionality & powers of the elected state legislative assembly, upon whose recommendations members are nominated to RS.
Nominated members merging in opposition, going rouge is a direct assault on the mandate of people. Should be nullified
