The third argument was anti-commandeering. #SCOTUS concluded “When a federal statute applies on its face to both private and state actors, a commandeering argument is a heavy lift—and petitioners have not pulled it off.”

Next they said Congress doesn’t have the authority to pass a law like #ICWA in the 1st place. To this, #SCOTUS concluded that’s it’s own precedent gives Congress broad powers in Indian affairs & if there are arguments that ICWA exceeds that power “petitioners do not make them”.
