家庭連合における解散命令。 国際法では「公の秩序」をどう読むのか？ 東京高裁が家庭連合に下した解散命令は、国際人権法の枠組みに収まるものなのか。 フランスの人権弁護士パトリシア・デュヴァル氏が、自由権規約(ICCPR)の条文に立ち返って検証した。 鍵を握るのは、日本の裁判所が持ち出した「公共の福祉」や「社会的相当性」という言葉と、規約第18条3項が定める「公の秩序」という言葉の、意味するところの違いである。 似て見える二つの概念が、実は別物ではないか。 デュヴァル氏は『注釈民法』や英米法系の法律辞典を引きながら、その境界線を引き直した。 「単にある行為を『反社会的』と呼ぶだけでは、公の秩序を発動するに足る重大性があるとは言えない」 そしてこの論考では、国連の関連文書が複数取り上げられる。 自由権規約委員会の解釈指針、1981年の国連宣言、信教の自由に関する特別報告者の2005年報告書、そして2014年に国連から日本政府に出された勧告など。 国家が宗教に対して中立であるとはどういうことか？布教活動はどこまで守られ、どこから制限され得るのか？ 日本の刑法には"脅迫"や"恐喝"、"準詐欺"といった規定があるにもかかわらず、家庭連合の献金勧誘に対してこれらが適用されたことは一度もない。 この事実が示す意味とは？
