Partner Carol C. Villegas spoke with @Law360 about the upcoming Supreme Court argument in Salazar v. Paramount Global, a matter that could have major implications for consumer protection and data privacy litigation. As legislation addressing tracking technologies used for targeted advertising has yet to be enacted on a federal level, the plaintiffs’ bar has increasingly turned to older statues like the Video Privacy Protection Act (VPPA), which was enacted in 1988 to prohibit the unauthorized disclosure of certain personal information belonging to "consumers" that rent, purchase, or subscribe to "a video tape service provider.” This rising tide of data privacy litigation raises broader questions about how courts should interpret laws that predate modern technological capabilities. Salazar brings one of these disputes to the forefront. In the case, Plaintiff Michael Salazar alleged that Paramount Global violated the VPPA by sharing personal information about its newsletter subscribers with Facebook, but a divided Sixth Circuit found that Salazar didn't qualify as a "consumer" under the statute because he wasn't someone who subscribed specifically to audiovisual materials, conflicting with the Second and Seventh circuits' broader view of what qualifies as a “consumer” under the VPPA. In the upcoming SCOTUS debate, Carol anticipates that the Plaintiff will argue that limiting the application of the VPPA to consumers who directly subscribe to audiovisual content would leave them unprotected when it comes to the broader sharing of their personal data. A serious concern for consumers, as “we would obviously want an outcome that gives consumers more control over the collection of their personal information and allows them to be protected whenever their information is shared." However, Carol notes that the plaintiffs’ bar will not be deterred, no matter the outcome. If SCOTUS limits the application of the VPPA, plaintiffs will need to "get a little more creative" about how they plead their complaint, pointing to the increasing consensus among the population “that we need to be paying attention to what's happening online and the type of personal information that's being shared, which is likely to result in more cases being filed around these issues.” Read the full article here: law360.com/appellate/arti… #Law360 #SCOTUS #ConsumerProtection #DataPrivacy #VPPA
