GUILTY VERDICT: In Oregon, rainwater falling on your own land doesn’t actually belong to you. Gary Harrington built 3 reservoirs on his 170-acre property to collect rainwater & snowmelt for fire protection. The state demanded he drain every drop. “All water belongs to us.” He refused. They hit him with 9 misdemeanors, jailed him for 30 days, and fined him more than $15,000. This is government claiming ownership of the sky.

What we are witnessing with Chief Justice Richard Wagner's refusal to recuse himself from the Appeal on the Emergencies Act is an historical moment. I will write more on this later but my point is this: The age old adage - "Justice must not only be done but be seen to be done" - is facing its greatest challenge in Canada with this decision. Consider the Chief Justice Bora Laskin dispute with Justice Thomas Berger in the 1980s (theepochtimes.com/opinion/the-po…) The National Post reports: "Chief Justice Richard Wagner dismisses request to recuse from Emergencies Act appeal Wagner called the Freedom Convoy protest the 'start of anarchy' and said participants took Ottawa residents 'hostage'" "In a letter to parties on Wednesday, Supreme Court of Canada registrar Chantal Carbonneau said Wagner believed there was no legal reason for him to step aside from the case, which the top court is currently considering if it should hear. ... “I am writing to advise that Chief Justice Wagner has considered the certificates and letter, and has concluded that there is no actual or reasonable apprehension of bias that would require his recusal under the applicable legal test,” Carbonneau responded to parties. ... “In this respect, Chief Justice Wagner has advised that he did not, at any time, either directly or indirectly, comment on the Emergencies Act, RSC 1985, c 22 (4th Supp) or matters at issue in the proceedings,” she added. Montreal-based newspaper Le Devoir, Wagner said in French that some participants in the Freedom Convoy protests were “remote-controlled” people looking to short-circuit the political system, something that “does not fill me with good feelings.” “What we saw recently on Wellington Street, here, is the budding start of anarchy where some people decided to take other citizens hostage, to take the law into their own hands, to disregard the system … I find that worrying,” he said in French. Canada’s top judge also argued that the occupation of downtown Ottawa was fuelled in part by a “certain ignorance” and a “bad understanding” of Canadian law, the newspaper reported. Chief Justice Richard Wagner is refusing to recuse himself from the Emergencies Act case, despite previously calling the Freedom Convoy the “start of anarchy” and saying protesters “took citizens hostage.” He has clearly shown his bias. Now he says there’s “no reasonable apprehension of bias.” That’s a problem. You don’t publicly characterize one side in those terms, then turn around and sit in judgment over them. This isn’t about whether he believes he’s impartial, it’s whether a reasonable person would. Do you or I believe him to be unbiased with everything we currently know? From his comments I don't see him as unbiased on this matter. When the Chief Justice has already framed the conduct as “anarchy,” the answer isn’t complicated. It's a given. Even Mahmud Jamal stepped aside in another case to avoid becoming a distraction, not because he had to, but because public confidence matters. That’s the standard. This isn’t just about one case, it’s about whether the public believes the process is fair. Because once that’s gone, the ruling doesn’t matter. No one will believe his "findings." And we currently have a government that are happy to ignore 'bias' in their favour if it adds momentum to their current goals. #onpoli #cdnpoli
