This law isn't peculiar to Ghana. Similar provisions for secret, court-authorized interception of communications (ex parte warrants, no user notification, provider compliance required) exist in nearly every country with modern telecom laws, based on global standards. 20 examples: USA (FISA/CALEA), UK (Investigatory Powers Act), Australia (TIA Act), India (IT Act 2000), China (Cybersecurity Law), Nigeria (NCC regs), South Africa (RICA), Kenya (Communications Act), Brazil (Law 9296/96), Mexico (Federal Code), Russia (SORM), France (Code of Criminal Procedure), Germany (Article 10 Act), Japan (Telecoms Law), Singapore (Cybersecurity Act), Canada (Criminal Code), New Zealand (Search and Surveillance Act), Italy (Code of Criminal Procedure), Spain (Criminal Procedure Law), South Korea (Telecoms Act).

Did you know that in Ghana, investigators can legally read your messages, listen to your calls and access your data without telling you? It’s in the Cybersecurity Act, passed in 2020 and here’s how it works: They go to the High Court quietly, without you present and without informing you. If the court approves, your network provider is legally required to hand over your information and stay silent about it. There are three levels: Your account details. Who you are, your address, your billing info. Your traffic data. Who you called, when, for how long, from where. Your actual messages and calls. The full content of what you said. For the first two, they just need to show the court “reasonable grounds” to suspect you. For the third, your actual conversations, they need a slightly stronger reason. National security. A serious crime. Economic interests of the state. That’s it. No warning. No notification. Your provider can’t even tell you it happened. This is not a rumour. It is Sections 69 to 74 of Act 1038, a law most Ghanaians have never read. Now you know 👍🏾

Law enforcement agencies can obtain a court warrant to intercept calls and monitor electronic communications under the CSA law which has existed for over 4yrs now ​While the police have these powers, the High Court acts as a gatekeeper to ensure the interception is proportionate and does not unnecessarily violate your right to privacy. Also, evidence obtained without a proper warrant is generally inadmissible in court and can lead to legal action against the state.

Last night’s @TV3_Ghana's #Agenda discussion on the SIM/Number registration exposed the real problem: the people driving the conversation are still not aligned on the basics. One side says nothing was wrong with the previous process. Another says they are still waiting to hear why a new registration is even necessary. Then NIA’s own position points to a serious credibility gap, with over 2 million SIM records reportedly failing biometric matching. That is not a small oversight. That is a structural problem. And that was exactly @LaryeaDerek’s point. This is not just about re-registering numbers for the sake of optics. The real issue is whether Ghana can confidently verify identity, trace fraud, and trust the systems behind the process. Right now, if money is sent to the wrong Momo number/person or a fraudster hides behind a weak registration system, the question is simple: can we reliably trace them? If the answer is NO, then the system has failed. This is bigger than politics and bigger than press statements. It is about data integrity, system interoperability, digital identity credibility, and public trust in national infrastructure. Until those foundations are fixed, repeating the process only risks deepening the mess. That was the clear difference last night. Some spoke to defend positions. Derrick spoke to expose the actual problem. You cannot solve a technical failure with political comfort.
