Illinois Gov. JB Pritzker’s new transaction tax on digital assets is drawing national attention. Something I’ve not seen mentioned in any reporting on this: In 2023, Pritzker said he would veto any financial transaction tax in Chicago. At the time, Mayor Brandon Johnson was floating a new tax on every trade at the Chicago Board of Trade and the Chicago Board of Options Exchange. That required a change in state law. Businesses were threatening to leave the city and the governor stepped in to calm their fears. "We have a terrific financial industry in the state of Illinois," Pritzker told Bloomberg at the time. "We all understand that a financial transactions tax simply would encourage them all to … move their servers across the borders of the state to some other state." But the governor just signed into law a new transaction tax on digital assets. The first of its kind in any state. And as Pritzker predicted back in 2023, industry leaders now predict “a profound chilling effect on digital asset activity in Illinois.” It’s looking like a classic example of a loss leader in tax policy. Meaning if the tax stands, Illinois is set to lose far more tax revenue than it gains, as these highly mobile firms choose to build elsewhere. The $60M digital asset tax is a rounding error in the state’s $56B budget (0.1%), which lawmakers passed at 4 a.m.
