They did try to set it a few years back...and the breeding industry revolted against them claiming they would bring lawsuits against it...or just start a different registry that they could get enough people in the industry to get behind to be declared the official one. The Jockey Club then backed down off of it.

@WelbourneStud @TheJockeyClub I was surprised @TheJockeyClub didn’t have better legal standing to set stallion book limits. As the breed registry, they’ve established a number of requirements and restrictions that must be met in order to register a Thoroughbred.

Years ago, I argued that @thejockeyclub had a lot of inherent power that it wasn't using. I still hold that belief. Whoever is providing legal guidance to the Board & taking such a timid approach to leadership on many issues is doing a larger disservice to the industry.

All I'm curious about in this particular case is how taking down the Jockey Club moves racing forward and allows it to grow and be regulated in a manner that would not be declared void by the courts. I happen to agree with a lot of complaints made against them, especially in the aftercare realm.

For not being an attorney, you sure seem to have a keen sense of 75 yr old case law on this matter. Call me genuinely curious and/or dubious of your “genuinely curious” position. Also, the Jockey Club, in its recent responses disagrees with your premise that it is not their responsibility to oversee and support certain aspects in the industry.

I am not a lawyer (something I think we ALL are thankful for), but there is still something regarding all this Jockey Club reform talk that has me puzzled, and perhaps a lawyer with knowledge of this area can answer it for me. The Fink v Cole decision by the NY Court of Appeals in 1951 basically took away the Jockey Clubs authority to license and regulate racing because it was ruled that the legislature cannot delegate regulatory authority to a private entity like the Jockey Club as it violates the non-delegation doctrine of the Constitution (something, kind of ironically, is one of the core arguments currently out there about HISA). This led to pretty much all of that authority being given more to racing commissions. So...this basically reduced the ruling power of the Jockey Club over things to the Stud book if I am reading into this right. Therefore, to everyone that is screaming for the Jockey Club to do more and be more involved and deal with the cheaters and illegal characters, aside from removing their privileges from the Stud Book...exactly what are you all expecting them to be able to do that would not be immediately challenged in the court as them overstepping their authority?? I agree change is needed in a lot of ways...but exactly how is it accomplished legally if the Jockey Club basically has its hands tied (no matter who leads or is part of it). Are you looking to have the law changed? Is there something I am missing where this idea could be challenged in court today leading to a decision that would give them more power? I genuinely am curious about this, as before the ruling The Jockey Club did tackle and handle many of the issues everyone is crying for them to address today.

I have an idea for the @jockeyclub. Just like trainers and owners, the agents and consignors of the sport should be licensed. One reason we are LOSING owners is because bad actors are taking advantage. I’m tired of hearing it’s not the jockey club’s problem. It is. It has to be. If you want to clean up the spot, and see it grow, this is another place to start.

That is why I am wondering what the "end game" desire is for all of this. Is it to just render the Jockey Club mute and void? Somehow reform it to make it more effective in things? Make their Stewards turn on the leadership and demand change? Just expose its shortcomings for shits and giggles? I know my comments come across as sarcastic (and with people who know me probably thinking that is the only way I comment on things...that is a completely valid way of thinking really), but I truly am wondering what the long term goal is with the specific attacks on the Jockey Club and trying to bring about meaningful change in racing.

The Jockey Club has done a very good job maintaining the illusion of power and control, largely due to the other (often nepotistic) loyalties and influences of their stewards. Given their financial security and age, they are believed by many to have actual power well beyond their actual scope.

@GakKromann @kathrynpapp What would you suggest this help be in the form of? Money? Different regulations? Hard cap on number of mares allowed to be bred by one stallion (one of the few things aside from money they likely have the power to do)?

My understanding when it comes to using the 2YO breeze sales as workouts is where they are listed. HISA only uses official works published in Equibase as basis for timed workouts. It is a thing that could be very easily remedied by just having the HISA board make a change in their rules allowing the breeze up times to be considered an official workout. Doesn't require anything else to my knowledge that would have to go through the entire rule making process.

@BradWeisbord @jockeyclub I think its a great cop out that HISA already doesn't. 2YO sales are absolute timed worked so therefore should be covered horses. Agents advise owners on covered horses so should be covered people. Suspended trainers aren't allowed to advise owners on covered horses...
