The defense can claim "it was obtained in a way that violates someone’s constitutional rights" (that's why they changed the law? right?) and all that evidence can be thrown out... especially by a biased or compromised judge who can work in the grey areas.

But if it was obtained in a way that violates someone’s constitutional rights like they did trump then it shouldn’t be able to be used. The problem is it’s been abused and it will continue

🚨Speaker Mike Johnson defended shredding the 4th Amendment and passing FISA warrantless surveillance after a top-secret briefing with the NSA, CIA, FBI, DNI and DOJ. Well, @RepThomasMassie was in the same SCIF as Speaker Johnson, and he's fed up with the lying. Massie says there was NOT ONE EXAMPLE spying on Americans without a warrant was able to prevent terrorism. It's all a scam. Shame on Republicans who fall for it. #SCIFGATE

@Fixitguy8 @RepThomasMassie Yes it does... but it isn't perfect and isn't capable of managing all contingencies. Ideological purity is a noble thing, but simply can't (or hasn't proven to be able) to defend the Republic from threats from within the system itself. Look where we are!!!

Also, the legal system is easily "gamed" by installing corrupt and/or compromised judges in strategic places. Lawfare. The legal system is highly compromised.

@Fixitguy8 @RepThomasMassie If the swamp isn't drained, more unconstitutional laws will inevitably follow... historical precedent here. People can now gloat about "killing FISA" while more laws are enacted or abuses are simply done "under the radar". This was political theatre, period.

The excuse of national security is laughable and is how we got the illegal patriot act that is permanent. And next time they need to renew it there will be another reason or crisis to justify

If the swamp can be purged, I believe that the process of removing unconstitutional legislation will happen. There is a silent war going on right now and FISA helps.
