Ministry of Power may move toward invoking Section 11 of the Electricity Act 2003. This is a "force majeure" style regulatory tool used during extraordinary circumstances. What will happen? The government is expected to direct 15 imported coal-based (ICB) plants to operate at full capacity to meet a projected record summer peak of 271 GW. Under Section 11, the plant can recover "full prudent costs." This means they can charge a higher tariff that covers the current spike in international coal prices, making it financially viable.
