It has been confirmed that U.S. authorities requested cooperation from the Korean National Police Agency regarding a visit to the United States by HYBE Chairman Bang Si-hyuk and other senior executives, who are currently banned from leaving the country due to an ongoing police investigation. Because the request directly singled out individuals subject to a travel ban and was made outside official diplomatic channels, criticism is emerging that it constitutes a “violation of diplomatic norms.”
According to a comprehensive report by Hankook Ilbo on the 19th, the U.S. Embassy in Korea recently delivered a letter requesting cooperation to the acting Commissioner General of the National Police Agency. The letter reportedly asked that HYBE Chairman Bang Si-hyuk, CEO Lee Jae-sang, and Vice President Kim Hyun-jung be allowed to visit the United States.
The stated reasons for the visit included attending the U.S. 250th Independence Day celebration scheduled for July 4 and supporting BTS’s U.S. tour as part of their ongoing world tour. Previously, President Donald Trump had announced plans to hold an unprecedented large-scale event in Washington, D.C., including a UFC match, to mark the Independence Day celebration.
The issue is that Chairman Bang and CEO Lee are currently under a travel ban as suspects in a Capital Markets Act violation. A request to cooperate with their U.S. visit is effectively the same as asking the police to lift the travel ban. Normally, lifting a travel ban requires a review committee convened by the Ministry of Justice upon request from investigative authorities.
Bang is accused of providing false information to investors before HYBE’s 2019 IPO, allegedly claiming there were no listing plans, and obtaining approximately 190 billion won (₩190 billion) in illicit gains. Police have already summoned Bang for questioning five times and are currently reviewing the legal aspects in the final stage. A final decision — such as applying for an arrest warrant or referring the case without detention — is expected soon.
Criticism is also growing that the request violated standard diplomatic practices, as it deviated significantly from typical diplomatic document procedures or inter-agency consultation norms. It is considered unusual for a foreign diplomatic mission to directly request cooperation from a domestic investigative agency regarding overseas travel of a person under investigation. Additionally, it was reported that the request was first made by phone and then the letter was delivered in person unilaterally. Typically, diplomatic matters or cooperation requests are coordinated through official diplomatic channels such as the Ministry of Foreign Affairs.
Police are reportedly treating the matter particularly sensitively because one of the key accomplices in the case left for the United States in June last year and has not returned since. Authorities cannot rule out the possibility that Bang and others could make contact with the accomplice. For this reason, there is reportedly strong internal sentiment within the police that it would be difficult to respond positively to the U.S. request.
