Achter de aanklachten schuilt de cruciale vraag of de rechtbank het aandurft om, op basis van het toeslagenschandaal, nieuwe civielrechtelijke jurisprudentie te creëren. Het hoger beroep van @pieksma_berber is gisteren door het Centraal Tuchtcollege voor de Gezondheidszorg in Den Haag verworpen. Pieksma was in hoger beroep gegaan na een negatieve uitkomst bij het Regionaal Tuchtcollege Zwolle. Ze werd bijgestaan door advocate @MeikeTerhorst. Voor Pieksma zelf heeft de uitspraak geen directe consequenties meer, want zij is inmiddels met pensioen en is niet langer geregistreerd in het BIG-register. Voor alle huisartsen in Nederland, maar vooral voor kinderen die het slachtoffer zijn van kindermisbruik is de uitspraak rampzalig. De uitspraak betekent namelijk dat huisartsen geen verklaringen mogen afgeven over de psychische toestand van een vermeend misbruikt kind, in ieder geval niet zonder toestemming te vragen aan de ouder die het kind misbruikt heeft. Het wachten is op een reactie van de Landelijke Huisartsen Vereniging (LHV)...
