שאלה טובה. קודם כל ברמה העקרונית כולם צריכים להתגייס. גם אלו שלומדים צריכים להיות מוכשרים ללוחמים כדי לדעת לאחוז בנשק ולצאת לקרב ביום פקודה כיוון שאנחנו במלחמת מצווה (הצלת ישראל מיד צר) וכמו שלמדנו: אפילו חתם מחדרו וכלה מחופתה. ואם תשאל אותי - אז חוק הגיוס? תשובה: תהליך. עברנו את הגיל של רבולוציות. כל התפתחות בריאה ואמיתית באה בתהליך אבולוציוני וגם אחינו החרדים לאט לאט מתגייסים יותר ויותר כפי שראינו בשבוע שעבר. דרך ארוכה שהיא קצרה. ולשאלתך, מבחינה נורמטיבית המרדה כמו כל עברה בחוק העונשין מצריכה לא רק יסוד עובדתי אלא יסוד נפשי של המרדה. קריאה לאי התייצבות או לסרבנות מקפלת בתוכה פגיעה בסדרי שלטון ובבטחון המדינה בשעת מלחמה. אי התגייסות של בני ישיבות לא ׳יושב׳ על אלמנט נפשי של המרדה. אין כאן כוונה פלילית להמריד. יש כאן בעיה אחרת אבל זה לא המרדה. ולסיום מתן, הקריאות לסרבנות פרקו אותנו וככל הנראה תרמו הן למוטיבציות של חמאס והן לחוסר המוכנות בשביעי. הקריאות לסרבנות עלו לנו במחיר כבד. עד היום הקריאות הללו לא טופלו במישור העונשי. טוב ונכון שהחוק הזה יקבל תמיכה גם מספסלי האופוזיציה ומכל מי שביטחון ישראל יקר לו.
