Drivers want to remain independent, and to be able to run their own business and work across platforms. More legal uncertainty and litigation is not what Member States want, as evidenced by the clear and large rejection of the proposed compromise.

Today’s rejection of the agreement on the #PlatformWork Directive confirms that the current text is not fit for purpose. A presumption of employment is not what drivers want, as they have stated repeatedly survey after survey, letter after letter, petition after petition.

We're concerned that the threshold to introduce a presumption is based on fulfilling only 2 out of 5 indicators. The indicators laid out, while aiming to classify employment status, do not take into account the nuanced realities that the Council sought to address in its GA. 4/4

While acknowledging efforts to address the complexities of platform work, we feel that the agreed-upon provisions fall short of meeting the wishes of platform workers. This provisional agreement fails to fully live up to drivers’ demands and needs. 3/4
