@BosCardHunter I’m not sure what fantasy world you live in since they broke their submission record first week, I don’t disagree that they’re a terrible company and need to make changes, but bad PR doesn’t mean shit when you have the monopoly they do, but whatever helps you sleep at night bud👍🏻
English

@Mutt_18 Very well actually. Probably the worst month of PR in the history of the company and the board brought me up 🤘 Next time check yourself before you make assumptions and get them wrong. Or don’t …. I’ll forget about you by dinner either way 🥱
English

@BosCardHunter Completely missing the entire point, but you’re just in it for the clicks regardless, congrats on him being an attorney that has no clue what he’s talking about…. you really showed me, how’s no PSA May going?
English

@Mutt_18 Wait wait wait aren’t you the one that said he wasn’t an attorney? Oof. Don’t worry I have two seasoned law professionals that I will be having on the YouTube channel Debating both sides of this.
English

@GivnerAriel Couldn’t have worded it any better myself, this “attorney”’s legal reasoning wouldn’t have held water in a 1L contracts class
English

This is so legally flawed.
The Alaska Packers case was about sailors already under contract who, stuck in remote Alaska, demanded more money for the exact same work they’d already promised to do.
Classic “preexisting duty” problem: you can’t demand fresh payment for doing what you’re already legally bound to perform. That new promise was unenforceable.
PSA’s situation is different.
When you submit cards, you affirm their Terms of Service. Those terms explicitly state (in plain language) that if PSA determines your card’s fair market value exceeds the insured limit of the tier you chose, they can require payment for a higher tier… or return the card ungraded.
That clause is baked into the original contract you accepted (I’ve read it numerous times). It’s not a mid-process rewrite like the Alaska Packers case, it’s actually just a contingency you agreed to upfront.
No “new consideration” issue because there’s no modification of the deal at all.
The mutual promises (your payment for their grading + insurance up to the chosen limit, with their right to adjust) were formed at submission.
The business practice IMO sucks and is why I’ve been holding off on having many cards graded, but the contract law analysis doesn’t hold water.

@BosCardHunter Would love his BBO number as I’m sure anyone in the legal world that’s engaged with this would as well so we can make sure to never hire him or whatever firm he works for.
English

@Mutt_18 Isn't trust me bro like outdated old twitter language. DM me and I'll put you in touch and you can see his credentials? Good? No trust me bro required.
English

@BosCardHunter “He’s an attorney, source: Trust me bro” His legal reasoning wouldn’t pass a first year law school contracts class so I highly doubt it.
English

@Mutt_18 He is an attorney so the first half of your tweet is incorrect. B could be true though don't worry!
English

@BosCardHunter Still stands, doesn’t take much research to figure this person A) isn’t an actual attorney or B) has no clue what they’re talking about as a few other attorneys have pointed out to you already in the comments
English

@Mutt_18 To be clear, I shared an attorney’s opinion; not a court ruling. But it’s still an interesting argument worth discussing as the engagement is proving.

Agreed just got this today, was listed as Near Mint, looks like it was stored on a pin cushion

Royals_Cards@Royals_Cards
I'm doubling down on the ebay feedback thing. I do not care. If you mark a card like this as Near Mint with this picture and tell me "yOu DeCiDe oN cOnDiTiOn" I'm leaving you negative feedback. Picture on the listing. Card in hand. this is not minor indents

Nah, we’re good.

Boomers: “You just need to work harder” I’m the only person in my friend group that was able to buy a home before I turned 30 while I worked a full time job with two side hustles doing content for DFS and flipping cards and my fiancee (now wife) landed a great job out of her graduate program. Meanwhile they got handed jobs out of high school and had to pay 15% of their income to own a home.
