South Africa has constitutionally mandatory guardrails for the economy and social life that dictate transformative governance to ensure economic parity through restitutive measures as acknowledged by the Constitutional Court in Minister of Finance v Van Heerden. Such are also permissible under Article 1(1) of ICERD which clearly states special measures solely taken to advance disadvantaged groups do not constitute discrimination. Additionally, BEE rules equally apply to black owned companies such as Royal Bafokeng. Also worth noting is that Commerce restrictions for strategic national purposes is not unique to SA. The US forced TikTok and others to have local US ownership. You could say that’s discrimination on the ground of nationality in violation of the Universal Declaration on Human Rights but the truth is it’s more nuanced than that.
