Breaking: DeCarlos Brown Jr. has been found “incapable to proceed” on the state murder charge brought against him in the killing of Ukrainian refugee Iryna Zarutska, according to court filings.
Brown, a 35-year-old homeless man who previously told police he was diagnosed with schizophrenia, faces both state and federal murder charges in the August light rail stabbing of 23-year-old Zarutska. The results of his capacity evaluation were revealed in a motion his state public defender filed in Mecklenburg Superior Court on Tuesday.
In the motion, attorney Daniel Roberts asked a judge to again delay Brown’s Rule 24 hearing — in which prosecutors would have said whether they plan to seek the death penalty in the case.

Schoolgirls Given Rape Alarms in Scottish Town Amid Fears of Being Stalked by Hotel Migrants
Schoolgirls in a Scottish town have been handed rape alarms by police over fears they were being stalked by illegal migrants being housed in a nearby hotel.
The intervention from officers came after it was alleged that the men had been taken photos of the girls in between lessons in Dumfries.
One concerned mother has claimed the harassment has left to some girls feeling too frightened to walk the streets of the Scottish town.
The hotel migrants have been spotted hanging around the school and ogling at children during break times, according to The Sun.
The hotel in Dumfries has seen protests erupt outside after a man being housed there was arrested following a "child protection" concern.
Scottish Conservative MSP Craig Hoy described the reports as "deeply alarming".

UAE, Kuwait, Bahrain report attacks despite Iran-US ceasefire
Several Gulf nations have reported missile and drone attacks on their territories, hours after Iran and the United States announced a two-week ceasefire.
The United Arab Emirates (UAE) on Wednesday said its air defences “are actively engaging” incoming missiles and drones from Iran.
The UAE’s Defence Ministry said in a statement that the sounds of explosions heard in different areas across the country were caused by air defence systems intercepting ballistic missiles, cruise missiles, and unmanned aerial vehicles.
Operations at Abu Dhabi’s Habshan gas complex were also temporarily suspended after a fire broke out early Wednesday due to falling debris, the Abu Dhabi Media Office said.
The interception also injured two Emiratis and one Indian national, the media office added.
Kuwait also said its air defences were intercepting a wave of Iranian drones launched since 8am (05:00 GMT), according to its army.
The Kuwaiti army said some drones targeted vital oil facilities, power stations and water desalination plants, causing serious infrastructure damage.
Bahrain’s Ministry of Interior also reported alleged Iranian attacks, which injured two people, hours after the US announced the ceasefire with Iran.
