@kerry_underwood @paulistapark Supreme court are unlikely to hear it in my view. They rarely muddy their hands with costs, so it will likely stand (until the act is reformed which might happen by 2074 if we're lucky!)

Court of Appeal has this morning refused Permission to Appeal to Supreme Court in Menzies v Oakwood - so payment of a bill for Solicitors Act purposes made when costs deducted from damages if pre-authorized in the retainer.

...who serves replies late can't be in a worse position than those who do not serve them at all). Had the PP specifically asked for replies or set out key issues where they needed clarification I suspect the situation might have been different.

Recently the senior costs judge (ex tempore decision) considered whether serving very late replies was a factor to take into account under 36.17(5)(c)and (d).He concluded it was not relevant, due to the voluntary nature of replies (& accepted that it can't be right that a party..

@BarbaraRich_law Also, all lawyers know that judges (even the court of appeal!) Can get things wrong-i have no idea whether that's true here or not- but the public seem very quick to jump to the conclusion that there is some conspiracy work when no evidence exists.

This is the application for permission to appeal to the UK Supreme Court. Note the estimated figure for trial liability of under £600,000 and the emphasis on the application being made on the grounds of Convention rights, not the application of English costs law rules by the CoA

Can one judge make a costs order and a different judge undertake the summary assessment? No says the court of appeal in case handed down today, where I acted for the appellant. The judge making the order must conduct the summary assessment. caselaw.nationalarchives.gov.uk/ewca/civ/2023/…

Those of us who visit the SCCO regularly have a head start on calling Masters "judge" in court as we've had to get out of the habit of addressing them as Master for some time now. All appear forgiving of the occasional slip...Personally I think "Master" is outdated.
