I am deeply saddened to learn of the passing of Hajiya Umma El-Rufai, the matriarch of the El-Rufai family. I have fond memories of shared moments with her and her motherly care. At a time like this, words can offer little comfort for such a profound loss. My heartfelt condolences to Mallam Nasir El-Rufai and the entire family. May Almighty Allah forgive her shortcomings, grant her eternal rest in Aljannah Firdaus, and give the family the strength to bear this loss. - NR

I do not know where we got the ideas of compulsory 2nd term of office by governors and President in Nigeria from. Yes it is true that the Nigerian constitution provides that the President and Governors can run and be elected for term of four years and the can seek re-election for another term of office for four years making a cumulative eight years, the Nigerian constitution did not assume automatic reelection for another term of office.
Such reelection should be subject to satisfactory performance in the first term. But in Nigeria whether the governors and President performed well or not the sycophantic DNA of praise singing swells the heads of the occupants of these offices and they now assume the rights of automatic reelections. As a matter of fact most governors after completing their failed two terms of office have always planted their stooges in the various states.
While the constitution allows for two terms these governors have their stooges in power that they remote controlled as governors. Today in Nigeria there is no democratic accountability. What we have is despotic imposition of people in power. The arrogance of politicians in undermining the sovereignty of the people is beyond comprehension in Nigeria. And to worsening the situation all institutions of democracy have been polluted and compromised by corrupt political system that encourages lack of transparency and accountability in governance.
In true democracy votes of the people matters great deal. But not in Nigerian brand of democracy. In Nigerian brand of democracy votes are usually allocated in favour of those who have no respect for the people and the welfare of the citizens. In most states you hardly can see good governance. Promises made are not kept. The institutions that have responsibility to act on behalf of the people are themselves infested with the incurable viruses of compromises.
If we truly practice democracy and rule of law, many of Nigerian politicians across political parties should have ended in jail by now. The irony of the whole thing is that those thieves know that they are thieves and their people also know that they are thieves but in the words of Prof Patrick Lumunba, people protect and defend them because they are their thieves.
Many people in the opposition and in power today are the same people who have destroyed the fabric of Nigerian democracy and good governance in Nigeria. When these politicians are out of power they have solutions to good governance and the rule of law. When out of power they want everything done according to the rule of law. But when they are in power rule of law does not matter to them.
There is a need to put limits to the numbers of years Nigerian politicians should occupy public offices. Most people in power and politics in Nigeria have been around of political leadership since 1999. They migrate from one office to the other. Most of these politicians have no visible means of livelihoods before they joined politics.
Today most of them are stupendously wealthy with unexplained wealth to the irritations of decency and accountability. Most of these politicians have so entrenched themselves in power with very dubious political positions that produced nothing good for the people. Nigerians are in extreme poverty and these politicians have no regards for the people. Votes do not count in Nigerian brand of democracy. That is the truth. Elections are not elections. They are just selectocray instead of democracy.

I have managed to locate the 2011 report of the @njcNig Committee that investigated the allegations against then CJN Aloysius Katsina Alu & then PCA, Isa Ayo Salami. It runs into 59 pages. Former President of the @CourtOfAppealNG, Umaru Abdullahi, chaired the Committee.
The disclosures & claims in the report are mouth-watering. But it is the absence of either indignation or credible rebuttal of the claims that is even more revealing.

We all saw Marshal's voice and it's clear his utterances, behavior and actions has more to someone who has interest in a monetary deal.

I would appreciate it if you could provide more context or information about Madam Tracy Ohiri's offense in this matter. The lawyer she engaged is incapable of treating her client with dignity, instead threatening to quit the case due to Ohiri's request for her balance. Barr Marshal is an incompetent lawyer who should be disbarred. He ambushed his client and made her a target of ridicule by her aiders, Nigerians. By requiring her to make a video apology to retract her authentic testimony against her debtor, Which could be used against her in court.

REFLECTIONS ON MARSHAL, TRACY AND UMAHI
Marshal Abubakar went out of his way to rally support for Tracy Ohiri. She was going to be remanded in custody, but for the very timely, vehement and strategic actions of the learned counsel.
It is easy to say that he was doing his professional job. But how many lawyers will be willing to put up such a fight against the Police and a serving Minister and former governor in this country?
Tracy walked out of the lion’s den unhurt.
From what the public has been told, her initial claim of indebtedness stood at about N25 million. She is said to have added interests on the sum which brought it to over N300 million.
I have examined the evidence available in the public domain, my view is that we’re dealing with a case of destructive greed and entrenched ingratitude.
A contract that was performed more than ten years ago cannot be enforced in 2026 without the debt being acknowledged by the debtor.
It is statute barred.
Umahi refused to acknowledge the debt and insisted on using law enforcement to fight Tracy Ohiri.
While the Minister’s oppressive actions are questionable and condemnable, the reality is that the alleged sum isn’t recoverable due to the fact that the cause of action, assuming there is one, is statute barred.
Beyond the issue of limitation period, the failure of Tracy to adduce evidence to prove her claims makes her case more untenable.
Sentiments cannot supplant elementary legal principles.
Marshal, with the support of activists, was able to secure a N110 million settlement for Tracy. Umahi, ostensibly acting through his proxies, agreed to discontinue all his legal actions against her.
The suggestion that the lawyer betrayed or coerce her does not hold water. How did he betray her? The same lawyer declined the monetary offers made to him.
If you have an understanding with a client, and the client reneges on it, it is irritable.
She was given the option of declining and returning the money but she decided to keep it.
By the way, the total amount she paid her lawyers is less than ten percent of what she received.
Some strange people are seeking to use this case to attack “human rights lawyers” and “activists”. They are questioning the lawyer for accepting fees despite being a human rights lawyer.
This is wickedness.
A human rights lawyer is a lawyer.
There’s no special university or law school in this country for training “human rights lawyers” or “activist lawyers”.
It is disrespectful and wicked for people expect lawyers who are devoting their professional career to fight dangerous causes for the oppressed to work with empty stomach.
Human rights lawyers have bills to pay, they have families to cater for, they’ve offices and staff to look after.
Nigerians should stop feeling entitled to pro bono services. If a lawyer elects to offer his services pro bono, it is out of goodwill.
I disagree with those who say that Marshal did not represent her well. Such view may be due to lack of adequate information.
A client who records a conversation with a lawyer has ulterior motives. We should not shy away from this issue.
In the record, the lawyer was evidently frustrated.
There is no part of the said audio recording where the lawyer told her that she was going to receive N305m or any specific amount.
Please prove me wrong.
In the audio, the lawyer made it clear that the undertaking made to him via messages by Umahi’s friend, who happens to be a lawyer, was sufficient.
It is ridiculous that Tracy expected Umahi, who has been denying the alleged debt, to sign a written undertaking. Such a demand would have been reasonable if the debt wasn’t disputed.
From the audio, one can deduce that Tracy was going back on her understanding with Marshal. That was why the lawyer told her not to call him again after that day.
We should be objective and fair minded.
May we not help or fight for people who will embarrass or seek to destroy us.

The underlying principle behind settlement of civil cases is that parties are willing and capable of foregoing their strict legal rights and obligations.
You are stating theories that have no real value in litigation.
Settlement is about concessions.
What parties are willing to settle for is often determined by their knowledge of the weaknesses and strengths of their cases.
