As interim measure, the Court has directed the constitution of State Mental Health Review Boards within a period of 45 days.The Court has further directed that the Boards after constitution will visit the correctional homes and submit detailed reports to the Court for monitoring.

The State of Assam has informed the Hon’ble Court that 3 weeks would be required to find out suitable premises for detention centres outside jails and make necessary modifications. The matter is next listed on 11.11.2020.

Instructions have also been issued that in case suitable premises are not available, private enterprises will also be looked into.

Drawing from the above finding, the Hon’ble Court has directed the Home and Political Affairs Dept. of State Govt. to submit an action taken report by Oct. 16 as to what steps have been taken to set up detention centres outside the jail premises in compliance with the law.
