“There are no highways or freeways in Namibia,” Works and Transport Minister Veikko Nekundi says in response to an urgent court application by activist Michael Amushelelo, who wants speed humps on the B1 Western Bypass removed.
In an answering affidavit filed in the Windhoek High Court, Nekundi says Amushelelo's case rests on the premise that the speed humps were placed on a highway or freeway, but he argues that neither category currently exists in Namibian law.
According to Nekundi, the Roads Ordinance recognises only trunk roads, main roads, district roads and farm roads.
He says a trunk road may be declared a freeway through publication in the Government Gazette, but no such declaration has been made in respect of the road in question.
Nekundi has asked the court to dismiss the application, arguing that Amushelelo has not demonstrated that he is affected by the speed humps.
The minister says Amushelelo claims to act on behalf of road users but does not identify those individuals or explain why they cannot approach the court themselves.
The matter will be heard this afternoon at 16:30 by High Court judge Gabriel Komboni.

This is such a terrible initiative. The problem isn’t even speeding but the attitude of pedestrians who cross that section of the road to northern industry. Very careless and irresponsible when crossing the road. They must rather make J-walking a crime.
