Should access to electoral courts be restricted to curb abusive lawsuits? Probably not—they're essential for election integrity. But policies like loser-pays rules, fines for bad-faith cases, or limits on certain pre-election filings could help reduce frivolous lawsuits.

Courts ensure fair elections, but electoral lawsuits can also be used to attack opponents or discredit the process. For instance, none of the 400+ lawsuits filed before the 2020 U.S. election succeeded in court, and the most recent election saw a similar number of cases.
