If our courts think that a 31 year old able bodied woman can't earn for herself and a student must pay for her just because he's the husband, our Judges now need refresher training on what gender equality means.
This boy was compelled to marry at 16. This is actually a case of sexual exploitation of a boy by an adult woman as she was 25 then. But he is the one being punished now!

▪️Punjab and Haryana HC directed a 22-year-old engineering student to pay ₹2,500 interim maintenance to his 31-year-old wife, observing that a husband has a legal duty to maintain his wife and cannot evade this responsibility merely on the ground of being a student. ▪️On facts, the husband argued that the marriage took place in June 2020 under compelling circumstances when he was a minor (16 years and 4 months old), while the wife was 25 years old. The couple had no children, and he later sought annulment under the Prohibition of Child Marriage Act in 2023. ▪️He further contended that he was a full-time student with no independent source of income and that his family survived solely on his mother’s ₹3,000 widow pension. It was also argued that the wife was not destitute, as she resided with her earning family members. ▪️Rejecting these submissions, High Court reiterated that Section 125 CrPC is a social justice measure aimed at preventing destitution and vagrancy. It is not punitive in nature but ensures basic subsistence for a dependent spouse. ▪️Relying on Supreme Court’s ruling in Shamima Farooqui v. Shahid Khan, Court noted that pleas of unemployment or lack of income are often “bald excuses” and do not absolve a husband of his legal duty, especially if he is able-bodied and capable of earning. ▪️Court observed that the husband was healthy and capable of earning, and noted that even a daily wage labourer earns around ₹12,000–₹13,000 per month. ▪️Considering rising living costs, Court held that ₹2,500 per month is minimal and justified, and accordingly dismissed the revision petition filed by the husband against the order of Family Court, Faridabad. #Mentoo #HighCourt #Maintenance #law #student

He was just a 16 year 4 months old boy when he had to marry this 25 year old woman under compulsion
He filed for annulment of marriage
She sought maintenance from him
He told the court he's an engineering student dependent on pension of his widow mother himself
He is 22 year old today and the woman is 31
But the court said even a daily wage labourer earns 12K, 18K so why can't he and that being a student is no excuse not to pay maintenance
Widow pension his mother receives is 3000
Maintenance he now needs to pay is 2500. Which means he must earn while attending his college. But this 31 year old woman can't as per our courts

मेरठ के पूर्व जज साहब ने तो अपनी बेटी के तलाक़ को लेकर तो पूरा रायता ही फ़ैला दिया है. अब उन लोगों पर कार्रवाई करने की धमकी दे रहे हैं जो लोग ससुराल पक्ष के द्वारा लगाए आरोप को सामने रख रहे हैं.
तलाक़ होने के बाद गाजे-बाजे के साथ बेटी को ससुराल से वापस लेकर आए तो ख़ूब वाहवाही हुई लेकिन जब लड़की के ससुर ने लड़की की करतूतें सबके सामने रखी तो लड़की के जज पिता सुप्रीम कोर्ट जाने की धमकी दे रहें हैं.
लड़की पर ससुराल पक्ष ने आरोप लगाया था कि लड़की पक्ष वालों का हस्तक्षेप अधिक था, बच्चा होने पर मुंडन संस्कार में ससुराल पक्ष वालों को पूछा नहीं गया!
