HISTORIC: A major win for Kenya's banking fraternity as the Supreme Court overturns the November 2020 Court of Appeal judgement on Civil Appeal No.195/2017. The matter relates to Petition No.12 (E014)/2022: Absa Bank Kenya Plc vs the Commissioner for Domestic Taxes. Interested parties to the matter were the Kenya Bankers Association & Mastercard Asia Pacific Ltd. What does this mean? · The Supreme Court has overturned the judgement that provided that fees earned by card companies in card transactions were royalties, within the meaning of Section 2 of the Income Tax Act, & therefore subject to withholding tax under Section 35 of the Income Tax Act · The Supreme Court has simultaneously overturned the judgement's ruling that interchange fee earned by an issuing bank constitutes professional & management fees and hence subject to withholding tax This is yet another judgement that reminds us that tax policy formulation flirts a lot with double taxation. We need to go back to basic principles. Here's the kicker "The appellant (Absa Bank) concedes to the fact that interchange fees are an income, but such income is already subject to corporate tax at a rate of 30%. To subject it to withholding tax would amount to double taxation. We find this argument compelling, given the fact that any income earned by a bank from its banking business (including credit card transactions) must be declared. Once declared, such income is automatically subject to a 30.0% corporate tax. The purpose of a withholding tax is to enable a taxing authority to keep track of any income that could escape taxation unless declared"

Why are we quick to brand such positive news as FAKE and only believe when deaths are reported? In as much as Italy is losing thousands through the Coronavirus there are more thousands who recover from it that no one seem to report. In fact there are more recoveries than deaths!
