In jr high, I had a friend who got his bell rung while we played backyard football. Everyone asked questions like "what day is it," & "who is the president," etc. (the '80's concussion protocol). The only question he got consistently right was "what is Tony's Pena's number?"

@seanmdav I understand the rule of judicial interpretation by which the court should not assume the legislature intended an illogical result, but I also am not a fan of legislatures abdicating their duty by lazily writing bad laws that invite courts to decide later what they mean.

The Supreme Court’s decision against Trump’s emergency tariffs is a complete mess, both as a matter of logic and construction, as the opinion has different majorities in different sections. The justices themselves couldn’t even consistently agree on the ruling. As Kavanaugh notes in his dissent, the decision effectively means Trump may unilaterally ban all foreign imports (an infinite tariff for all intents and purposes) on an emergency basis, but may not levy a $0.01 tariff on any good. You don’t have to be a lawyer to see how stupid and illogical that is. But given his Obamacare decision, Roberts has made clear that stupid and illogical is the defining characteristic of Roberts’ tenure as chief justice.

Riddle me this. Four major Big Law firms are counted on the side that thinks men have a legal right to play in women's sports. There are zero major firms on the other side. Some good boutiques, no doubt, but oddly these small firms are even representing multiple amici in the case filing separate briefs (a weird thing before SCOTUS). Not a single Big Law firm to be found to represent these amici seeking to weigh in on an issue that is 80/20 in the normal world. Think about that.

@ChrisLongKSTP I did not have a rooting interest in the game last night. Had reasons to root for or against either team, but he was pretty much the single biggest reason I was rooting for Miami to be done - bc of things like this. I kept hoping for Ray Isom to swoop in and take him out. ;)

@schadjoe Couldn't be more wrong. Now, in early November there are DOZENS of teams still in contention for the championship. It used to be there might be 4 or so still playing for it by then. So many games in late October or November are MORE compelling now. Not less.
