@Freedom2091 @BillMelugin_ @JoeAlv Bleating on repeating patently false information doesn't make it true. Administrative warrants do NOT allow ICE to enter private homes or fenced property. Administrative warrants only apply in public or open spaces. And detention is absolutely a seizure under the 4th Amendment.

@StrayDataPoint @BillMelugin_ @JoeAlv Detaining someone is not a search and seizure. Courts have ruled police can frisk a person being Detained. And searched if they believe they have a weapon or other illegal items

BREAKING: Texas federal judge Fred Biery (Clinton appointee) has ordered the release of 5-year-old Liam Conejo Ramos & his father from ICE detention in TX. In his decision, he includes a photo of the boy and gets today’s date wrong (Feb 31st doesn’t even exist) while saying that ICE’s administrative warrants “do not pass probable cause muster…that is called the Fox guarding the henhouse…the Constitution requires an independent judicial officer.” Judge Biery then goes on to write: “Observing human behavior confirms that for some among us, the perfidious lust for unbridled power and the imposition of cruelty in its quest know no bounds and are bereft of human decency. And the rule of law be damned. Ultimately, Petitioners may, because of the arcane United States immigration system, return to their home country, involuntarily or by self-deportation. But that result should occur through a more orderly and humane policy than currently in place.” Judge Biery’s LinkedIn page also shows him liking a post today about millions protesting President Trump’s policies.

@Freedom2091 @BillMelugin_ @JoeAlv My guy, the 4th amendment applies to ANY search/seizure. Civil or not. And supersedes administrative warrants based on the SC cases I listed. Why do you people insist on being so confidently stupid?

@BillMelugin_ @JoeAlv Which SCOTUS case created blanket approval of admin warrants? The 4th Amendment still applies. SCOTUS has never ruled ICE’s admin warrants override protections in residential areas. Payton & Jardines say officers need judicial warrant or consent to enter fenced private property.

@JoeAlv No he’s not. SCOTUS ruled on the legality of administrative warrants a long time ago. Judicial warrants are not required. Every single administration has used administrative warrants. If DOJ appeals this it will likely be reversed by 5th Circuit quickly.
