JUDGE, JURY, EXECUTIONER: AMERICAN EXCESS. 3 INDIAN LIVES & A TEST FOR INDIAN DIPLOMACY. This is the story of American military and executive excess on the one hand and the INEFFECTUALITY of Indian diplomacy on the other. It’s a story about the killing of three Indians on the high seas by a Trump led America that, critics argue, has increasingly exercised powers beyond those recognised under international law. Three Indian seafarers, deck cadet Aditya Sharma, engine fitter Shivanand Chaurasia, and chief engineer Patnala Suresh, found themselves in the crosshairs of the American Navy just off the coast of Oman in the Arabian Sea. The three Indian seafarers, along with 21 other crew members, were aboard the Settebello, a Palau-flagged vessel. Little did they know that they had been arbitrarily awarded a death sentence by a US Navy that was acting as judge, jury, and executioner. The munition fired by the US Navy that tore through the engine room vapourised the seafarers. The US Central Command said that the crew was guilty of violating an arbitrary American blockade by "attempting to transport oil from Iran". In fact, the statement accused the crew of having "repeatedly failed to comply" with American forces. Manoj Yadav, general secretary of the Forward Seamen's Union of India, has said that he "refused to believe" that the US lacked information regarding the nationalities of the people on board those ships. Why didn’t, he asked, the US simply detain the ship, especially since the ship was unarmed and its crew was absolutely defenceless? To be sure, Washington would argue that the vessel was engaged in sanctions-busting activity linked to Iran and that American forces were acting under their own rules of engagement. Yet even if one accepts that contention, serious questions remain about proportionality, due process, and jurisdiction. Was an unarmed merchant vessel posing an imminent threat? Could interception, boarding, or detention have achieved the same objective without loss of life? Those questions deserve answers. But the bigger and more immediate one is, who has given the US Navy the right to assume the role of lawmaker, law enforcer, and lawgiver? No one, if one were to strictly apply the tenets of the UN Charter. The Articles of the UN Charter strictly prohibit the use of force between states except in two scenarios: when authorised by the UN Security Council or in self-defence against an active or imminent armed attack (Article 51). Critics argue that the strikes lack a valid self-defence justification or Security Council mandate. Second, the US is, according to critics, enforcing an illegal blockade of the Strait of Hormuz. The UN's maritime agency, the International Maritime Organization, has consistently upheld the principle that no country has a unilateral right to obstruct international transit through strategic straits. If that principle is accepted, then the legal basis for the use of force against civilian shipping becomes even more questionable. While the US under Trump may be in contempt of the spirit of international law, the point is that the law needs to be read persuasively to the United States at the highest diplomatic level. Unfortunately, this is where Delhi appears to have arguably fallen short.
