Supreme Court Fully Empowered to Decide ADC Appeal Finally The leadership dispute within the African Democratic Congress (ADC), involving figures such as David Mark, has moved from the Federal High Court to the Court of Appeal and is now before the Supreme Court, where arguments have already been taken and the matter is positioned for judgment. With the complete record of proceedings before it, the Supreme Court has everything required to determine the appeal on its merits. Under Section 233 of the 1999 Constitution (as amended) and Section 22 of the Supreme Court Act, the apex court has full authority to affirm, reverse, or vary the decision of the Court of Appeal, make any order the lower courts could have made, and deliver final judgment. There is no legal requirement for the Court to remit the case back to the High Court. Remittal is strictly discretionary and only applies in limited situations, such as WHERE THE RECORD IS INCOMPLETE or key issues were NOT DETERMINED. Where the RECORD IS COMPLETE, nothing remains for the High Court to adjudicate The Bottom line is, Supreme Court is FULLY EMPOWERED to decide the ADC appeal conclusively and bring the dispute to a final end, without sending the matter back to the High Court.
