The motion points out that Megan previously asked the court to punish Milagro over alleged text-message preservation issues, and the judge granted her request for an adverse inference instruction. Milagro’s attorneys argue that fairness requires the same treatment here. They emphasize that Megan’s conduct was a direct violation of the court’s order and that her statements to the media were intended to prejudice the jury and affect the outcome of the trial.
