@MyLittleBloggie He has two claims: work comp (WC) and the PI claim against the state/landowner. He is entitled to WC benefits for his injuries. The PI claim requires he prove negligence to a jury. If he wins, he gets damages not payable under WC, and the WC insurer gets paid back per a formula.
Wouldn't Workers Compensation take care of this? And who the hell expects sidewalks to be completely clear of risk in the winter? It was shoveled and salted.
