Watergate was a simpler time. Gerald Ford's concern that prosecuting Nixon would 'tear the country apart' was due in part to the fact that Americans still venerated the presidency and elected leaders in general. Perhaps that was naive. The fact that Nixon was not prosecuted ushered in an era of belief in the imperial presidency that was not at all what our founders envisioned. It also paved the way for the concerns today that prosecuting a former president who has committed a multitude of crimes small and large will 'tear the country apart.' It was probably a mistake not to prosecute Nixon and it was in many ways the easier course not to. But Trump's crimes would make Nixon blush. And if we truly believe no man is above the law we must demonstrate it.
