Law should designed with its potential abuse in mind. The problem with this law is it was *designed* to be abused. This is made worse immeasurably with its section 33 use, because -with its abusive underlay- it claims not to ‘appealable’. This is utterly unjust. #onted #CUPE

This is *per day*, and conceivably the government could seize the entirety or more of the salary after 10 days. Some would say it is a maximum and only a threat, not intended to be used. But law should *always* be designed and conceived in its best and worst application…

Another issue with Ontario’s Bill 28 besides its use of section 33 of the constitution, is how it violates the concept of proportionality. Proportionality is the concept that the punishment should match the crime… (thread)

@MsAGilbert @PeelLabour Over anything not exclusively provincial for the purposes of “law, order, and good government”. Either way it will start a major legal battle between federal and provincial powers. One wonders whether this was the plan.

I am not an Ontarian, or a teacher, or an education assistant, but I have a perspective on the Ford government’s “Keeping Students in Schools Act”. I was Minister of Education in Alberta for 7 years, including the time the Charter was developed and enacted. #onted #onpoli

Which nearly severed the country, with a hairline vote in which Quebec did not separate. Arguably, our country is less unified than at that time, and if Ford - by abusing the Charter opens the can of Constitutional reform, there may be no reassembling the pieces afterwards.

I teach law and I am blown away and the speed at which precedent setting major changes have happened over the last 5-6 years. The most recent being that the Ontario government suspended the Charter to end labour negotiations and prevent a strike. No back to work (thread)
