@DigitalPastaFan @krillyboy @csmaddox2008 If that were true, Native Americans born off the reservation would have been granted citizenship prior to 1924. They were not. In other words, the precedent set by Native American policy goes against birthright citizenship.

@krillyboy @DigitalPastaFan @csmaddox2008 "All people, excepting American Indians (etc.) can be on US soil but not subject to the jurisdiction thereof." Correct. And this is the point. Being on US soil =/= being subject to US jurisdiction. This is why the amendment does not grant citizenship on birth alone.

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States." When it comes to abandoning the plain speech of the Constitution and trying to turn it into a "living document," we've reached the point where, yes, both sides do it. And we should reject both sides when they try to do it.

Lil gup doesn't know what an appositive is Can anyone tell me how, if their interpretation is correct, the mention of the children of foreign ministers isn't redundant? They'd already be covered by the mention of foreigners (Also you literally cannot be born here and an alien)

How fucking retarded do you have to be to believe that the original intent of the 14th amendment’s authors was for citizenship to be automatically granted to the children of tourists, illegals, and even enemy combatants who are being held on American soil? The man who wrote the amendment quite literally went on the Senate floor and publicly declared that it wouldn’t apply to foreigners or aliens.

@KaiSchwemmer Lol what? Do you have any evidence that fertility rates will be boosted? Afaik it's never been shown to be a wage issue Even countries that have extremely strict immigration have fertility issues. Foreigners are not the problem here

This is how we actually get deportations done. The issue of immigration touches everything. Want greater efficacy? Make employment verification online, and enforce immigration law at worksites. This will drive up wages, reduce exploitation, and eventually boost fertility rates.

This is already the case without birthright citizenship I'm a dual citizen! My foreign parent is a legal resident, and I was technically obligated to serve in the Brazilian military before I got an exemption
