Quick Mart has lost a Kshs. 14,918,750 case against Wells Fargo.
Quick Mart sued Wells Fargo after Kshs. 94.9 million collected from its outlets was lost in transit, arguing that the security firm had breached their contract by failing to deliver the money to the bank. Although Wells Fargo admitted the loss, it had already paid Kshs. 80 million and relied on a contractual clause that capped its liability at that amount. Quick Mart pushed for the balance, claiming each collection should be treated separately to bypass the cap.
The Court disagreed. It held that the contract clearly limited Wells Fargo’s total liability to Kshs. 80 million for the entire consignment, not per transaction. Since that amount had already been paid, Quick Mart’s claim for the additional Kshs. 14.9 million was dismissed. The Court also rejected Wells Fargo’s counterclaim for unpaid fees due to lack of proof, leaving both parties walking away without further compensation or costs orders.
