An Amherst MAGA who was previously pardoned by President Trump for his role in the Jan. 6 Capitol riot was sentenced to prison for possession of child pornography.
Thirty-one-year-old Daneil Tocci pleaded guilty to one count of the charge after federal investigators discovered a massive collection of illicit images during a search of his home and electronic devices.

A Hadley police officer initiated the investigation in January 2023 during a traffic stop involving Tocci. According to court documents, the officer recognized Tocci from photographs taken during the Jan. 6, 2021, breach of the U.S. Capitol and shared an image from the traffic stop with the FBI.
The FBI identified Tocci in multiple screenshots taken from inside and outside the Capitol building. Federal investigators noted that Tocci was seen breaking a shutter slat off a window during the riot. In November 2023, the FBI applied for search warrants for Tocci’s person, his apartment and his cellphone.
Those searches resulted in the discovery of more than 110,000 child pornography images. Authorities stated the images were compiled across a variety of storage drives and digital devices. Following the discovery, Tocci was charged with possession of child pornography.
After President Trump issued a pardon to Tocci for his involvement in the Jan. 6 riot, defense attorneys filed a motion to dismiss the pornography charges. The defense argued that the current case was a direct result of the initial Jan. 6 investigation, which the president had characterized as an injustice.
The defense team questioned the legitimacy of the evidence in their legal filing. “The evidence in this case was improperly obtained, through the “injustice” of the Jan. 6 investigation as recognized by the president,” the defense stated in the motion. “So the warrant in Mr. Tocci’s case should have never been issued and the evidence underlying this case should have never been seized.” The defense withdrew this motion 10 days after filing it.
During sentencing proceedings, defense attorneys requested a sentence of time served and 60 months of supervised release. This would have resulted in a sentence of approximately six months based on the time Tocci had already spent in jail. The defense argued in court documents that a childhood diagnosis of Asperger’s syndrome and a 2019 breakup led to a “downward spiral” that resulted in the crime.
