That is an unrealistic view of the law and relationships. After 30 minutes of cuddling then kissing, context matters.

She didn't kiss him, she gave no cues to escalate the exchange, if he misread her letting him kiss her face as a signal then fine, but then he acted on it in an extreme way. Also, they weren't together when this happened. I don't think he should be in jail, but I don't think she is defaming him by classifying it as SA.
