I listened to the press briefing held just moments ago by the Warri Council Of Chiefs It was very eloquent and well-reasoned, without a doubt. However, in no part of it did we mention the critical fact that the domain of the Ogbe-Ijaw king falls under the jurisdiction of Ogiame Atuwatse, the Olu of Warri, in Warri South West Local Government Area. I kept hearing references to the Ogbe-Ijaw king’s domain being in Warri South West. No, of course not. It is the people he rules who reside in Warri South West. He has no independent domain there. By law, Big Warri holds the possessory title to Ogbe-Ijaw, while the Olu possesses the radical title. This has been affirmed through multiple court judgments over the decades. The existence of a king there is solely because the Nigerian Constitution allows communities to select their own leaders. There is no law that has stripped us of the land and granted it to them. When you fail to protect what belongs to you, others will gradually claim every piece of it. Relevant Court Judgments on Ogbe-Ijaw Land Ownership To substantiate the legal position outlined above, here are key judgments establishing the Olu of Warri’s overlordship and the Itsekiri’s title over Ogbe-Ijaw lands: Supreme Court Judgment (1964): In a landmark ruling, the Supreme Court definitively settled land ownership disputes in Warri, affirming the Itsekiri’s (and by extension, the Olu’s) rights over lands in Warri Local Government Areas, including Ogbe-Ijaw. This has barred subsequent challenges by Ijaw indigenes. Warri High Court Ruling (2013, Suit involving Okere Itsekiri Community v. Delta State Government): Justice Marshall Umukoro dismissed an application by the Ijaws of Ogbe-Ijoh to join the suit as defendants, claiming ownership of disputed lands. The court explicitly barred the Ijaws from contesting ownership of any lands in Warri, reiterating the 1964 Supreme Court decision. High Court Judgment (Suit W/116/56: Eyin Pessu, Akowe Apoh (Itsekiris), and the Olu of Warri v. Brigbo and Others): Justice Obaseki granted a declaration of title in favor of the Itsekiri plaintiffs over Aruteghan Creek and all surrounding lands, including areas encompassing Ogbe-Ijaw settlements. The judgment confirmed historical leases granted by the Olu to the government for Ogbe-Ijaw in 1906, underscoring the Olu’s sovereign rights. These rulings, spanning from colonial-era leases to modern affirmations, consistently uphold the Olu’s radical title and the Itsekiri’s possessory rights, while recognizing Ijaw occupation as permissive under native law and custom, not ownership. No subsequent judgment has overturned this framework. The Warri South West Local Government Chirman Mr Sylvester Oromoni should be very careful on his inflammatory congratulatory message to the Ogbe Ijaw king.
